NOTICE TO PUBLIC OF INTENT TO REQUEST RELEASE OF FUNDS
TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS:
On or about May 15, 2017 the above named City, as the Responsible Entity, will request the Department of Local Government to release funds from the Kentucky NSP Revolving Loan Fund for the following project:
Project Title: Newport Millennium Housing Corp.-Entryway Inc Homeownership Rehab Project
Estimated Project Cost: $280,000 (NSP funds)
Purpose of the Project: NSP funds will provide construction financing for a portion of projected rehab costs.. Project Location: 217, 224 and 226 Forrest Street and 1042 Washington Avenue, Newport, Kentucky
An Environmental Review Record (ERR) has been made by the City which documents the environmental review of the project. The ERR is available for public examination and copying during normal office hours at the service desk on the second floor of Newport City Hall, 998 Monmouth Street, Newport, Kentucky. No further environmental review of this project is proposed to be conducted prior to the request for release of federal funds.
All interested agencies, groups, and persons disagreeing with this decision are invited to submit written comments for consideration by the City to the Office of the City Manager,998 Monmouth Street,Newport,Kentucky 41011. Written comments must be received before 12:00 Noon EDT, May 13, 2017. All such comments so received will be considered and the City of Newport, acting as the Responsible Entity for this project, will not request the release of Federal funds or take any administrative action on the within project prior to the date specified on the proceeding sentence.
Newport Millennium Housing Corporation III and Entryway, Inc. will undertake the project described above with NSP Revolving Loan Funds. The City of Newport, Kentucky, as the Responsible Entity, is certifying to the state that the City and Jerry R. Peluso in his official capacity as Mayor, consent to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval Newport Millennium Housing Corporation III and Entryway, Inc. may use the NSP Revolving Loan Funds and the state and HUD will have satisfied their responsibilities under the National Environmental Policy Act of 1969. The state will accept an objection to its approval only on one of the following bases:
(a) The certification was not in fact executed by the City’s Certifying Officer.
(b) The City has failed to make one of the two findings pursuant to SS58.41 or to make the written determination decision required by SS58.57, 58.53 or 58.64 for the project, as applicable.
(c) The City has omitted one or more of the steps set forth at Subparts F and G for the preparation and completion of an EA.
(d) No opportunity was given to the Advisory Council on Historic Preservation or its Executive Director to review the effect of the project on a property listed on the National Register of Historic Places, or found to be eligible for such listing by the Secretary of the Interior, in accordance with 36 CFR Part 800.
(e) The recipient has committed funds or incurred costs not authorized by this part before release of funds and approval of the Environmental Certification by HUD or the State.
(f) Objections have been made by a federal agency.
Objections must be prepared and submitted in accordance with required procedures (24 CFR Part 58) and addressed to the Department of Local Government,1024 Capital Center Drive Suite 340,Frankfort,Kentucky40601. Objections to the release of funds on bases other than those stated above will not be considered by the state. No objection received after 4:30 pm EDT, June 1, 2017 will be considered by the state.
